Transition of West Byron Urban Release Area land to Byron LEP 2014

We would like your feedback on a planning proposal to transition the West Byron Urban Release Area into the Byron Local Environmental Plan 2014.

The objectives of this planning proposal are:

  1. To rezone the land located within the West Byron Bay Urban Release Area (WBURA) currently zoned under the Byron Local Environmental Plan 1988 (BLEP 1988) into the Byron Local Environmental Plan 2014 (BLEP 2014) Zones
  2. To transition the relevant provisions of Part 4 West Byron Bay Site of the LEP 1988 into the Byron Local Environmental Plan 2014 (LEP 2014).

The planning proposal involves both mapping and policy changes to the 1988 and 2014 LEP.

Mapping changes

  • Introduction of the West Byron Urban Release Area map into the 2014 LEP.
  • Transition of the existing 1988 LEP height of buildings map into the 2014 LEP with no change to height limits.
  • Transition of the existing 1988 Acid Sulfate Soils map into the 2014 LEP, with no change to existing mapped acid sulfate soil areas.
  • An amended Land use zone map applying to the West Byron Urban Release Area is to be inserted into the 2014 LEP.
  • An amended minimum lot size applying to the West Byron Urban Release Area is to be inserted into the LEP 2014 to reflect the approved development consents for the subdivision of the Urban Release Area.

Policy Changes to the Byron Local Environmental Plan 2014

  • Insert LEP 1988 Clauses 99, 100 and 101 which relate to pre-conditions for development within an urban release area into the LEP 2014 which have no equivalent clause within the 2014 LEP.
  • Amend Clause 4.1E of the LEP 2014 to allow for the minimum lot sizes that are currently permitted within the West Byron Urban Release Area to ensure there is no change to the permissible density of the urban release area.

Policy changes to the Byron Local Environmental Plan 1988

  • The deletion of Part 4 of the BLEP 1988 in its entirety as following the changes to the LEP 2014, Part 4 will no longer apply to any lands within the Shire.
  • An amended Land Reservation Acquisition Map applying to the West Byron Urban Release Area is to be inserted into the LEP 2014 to reflect the approved subdivision and the land to be dedicated as public open space. Policy Changes to BLEP 2014.
